On December 27, 2012, the U.S. District Court for the Central District of California issued a preliminary injunction against Aereokiller (formerly known as BarryDriller.com), a service founded by Alki David, someone not unfamiliar with television transmission and the law.? Previously, in conjunction with rulings involving a similar technology at issue in?WPIX v. ivi?in New York, David?s prior television-over-the-Internet service known as FilmOn had been enjoined for making unauthorized public performances in violation of television networks? copyright rights under Section 106(4) of the Copyright Act.? This time around, David?s Aereokiller service was set up to create unique copies of broadcast television streams, one per user, so that the transmission of those streams would be a private ? not public ? performance to that particular user.?

Important to the facts of the case is the outcome in?ABC v. AEREO, involving a service on which David claimed Aereokiller was modeled.? In mid-2012, Aereo had prevailed in the Southern District of New York against a motion for a preliminary injunction against its broadcast-to-Internet service, on the ground that a 2008 Second Circuit decision known as?Cartoon Network v. Cablevision?insulated a retransmitter of copyrighted content from liability if the transmissions were made from individualized copies requested by the user.? In Cablevision?s case, the transmissions came from hard drives stored at Cablevision?s facility that were set up in such a way as to allow the service to appear to the consumer to function just like an in-home DVR.? With the ?RS-DVR? system in?Cablevision, subscribers would choose a show, hit ?record,? and play the show back from the copy saved in Cablevision?s facilities.? In Aereo?s case, the technology captured television broadcast signals on a series of dime-sized antennas, with one antenna assigned to each subscriber, located on a rooftop in Brooklyn.? From there, the broadcasts would be streamed to subscribers on an individualized basis.? The?Aereo?court found the architecture legally indistinguishable from that in?Cablevision. ?At the end of November, the parties argued the copyright owners? expedited appeal of the district court?s?Aereo?ruling.? A decision remains pending.

Just like the defendant in the?Aereo?case claimed that its system was designed in part to follow?Cablevision??to a T,? the defendant in theAereokiller?case claimed heavy reliance on?Aereo, stating that it was ?technologically analogous? to the system that the New York court found to be non-infringing.? Much of the briefing focused on whether this was actually the case; the plaintiffs argued in the alternative that the technology likely was essentially the same as the FilmOn technology.

Despite the parties? focus on the system?s architecture, Judge Wu avoided the issue entirely.? Rather than distinguishing the cases on their facts, the court rejected the reasoning in?Cablevision?and?Aereo, indicating that the current Copyright Act was subject to a different interpretation than the Second Circuit courts had reached.? In the Second Circuit, the judge explained, cases ?have held that where a transmission of a work over the internet is made from a copy of a work made at the direction of and solely for use by a single user, there is no public transmission.? ?But, the court noted, ?that Second Circuit law has not been adopted in the Ninth Circuit, and this Court would find that the Ninth Circuit?s precedents do not support adopting the Second Circuit?s position on the issue.?? As if to underscore the division between the Second and the Ninth Circuits on the question, Judge Wu expressly relied upon a Northern District of California case,?On Command v. Columbia Pictures, a case that the district judge in?Cablevisiondiscussed extensively, and which the Second Circuit criticized in reversing the lower court?s ruling.

In concluding its analysis on plaintiffs? likelihood of success on the merits, the court did find some analogous copyright precedent, but it was not the precedent from?Cablevision.? Instead, Judge Wu found Aereokiller?s arguments reminiscent of the arguments cable retransmitters made four decades ago in the?Fortnightly?andTeleprompter?cases ? rulings that Congress overturned by enacting the 1976 Copyright Act with the inclusion of broad definitions of what it means to ?transmit? a work and to perform a work ?publicly,? including by transmission.? The court further explained that the revisions to the copyright laws confirmed that whatever an individual might lawfully do for herself, the legality as to the individual has no bearing on the legality of what a commercial provider could do for a group of people.? Finding that in this case, as with cable operators, copyright royalties must be paid for retransmission of copyrighted material, the court refused to find?Cablevision?and?Aereo?to be binding.

Despite the pointed holding, the court?s ruling is limited geographically so as to not interfere with?Cablevision?or?Aereo?s reach.? Conscious of the differing interpretations between Judge Wu and his east-coast counterparts of the statutory language, the court found that the Aereokiller service could be limited to avoid reach into the Ninth Circuit and, as a matter of comity, issued its order accordingly.? Thus, depending on what happens on appeal both in this case and in?Aereo, we could see the geographic scope of the injunction flip or disappear entirely.? And if the?Aereokiller?and?Aereo?decisions are either both affirmed or both reversed, it may be the Supreme Court?s task to resolve the circuit split and again take up the question of copyright in the age of evolving television distribution.? Sony has had over a year now to dust away any residual Ericsson branding and with a reinvigorated direction towards mobile, it's welcoming the CES crowds of Las Vegas with two new smartphones -- the Xperia Z and the Xperia ZL. Both are running Android Jelly Bean, have 5-inch 1080p screens laced with Sony's new Bravia Mobile 2 technology, quad-core 1.5GHz Snapdragon S4 Pro and new 13-megapixel Exmor RS camera sensors, capable of recording HDR video.

Has Sony finally crafted a flagship able to go toe-to-toe with the competition? Well, the Xperia Z exudes class -- and it's light. With about the same thickness as the iPhone, the phone is similar with all straight surfaces, barring some slightly rounded corners. Sony's calling the design language "omnibalance" and you can expect to see similar design licks in its other products in the near future. Picking it up, it feels better and more premium than any phone we've seen from Sony before and, oddly, it's even waterproof. Comparing the Xperia Z against the Xperia ZL, the oblong, broad Xperia Z felt almost too big in our hands; the ZL felt much more at home. Sony's barely unveiled them on stage at its press event, but we got the chance to play with both devices earlier today, (just about) wrapping our fingers around both the Xperia Z and the slightly smaller Xperia ZL. Banks reach $8.5B settlement on mortgage abuse

Ten of the biggest U.S. mortgage companies have agreed to an $8.5 billion settlement with federal regulators that will end a case-by-case review program to identify victims of widespread foreclosure abuses.

With the latest multi-billion-dollar settlement, the nation?s giant mortgage lenders are hoping to put the mortgage mess ?behind them. But critics of the deal fear it may also leave behind millions of foreclosed homeowners who got little or no relief from the lenders that created the mortgage mess in the first place. ?

"I have serious concerns that this settlement may allow banks to skirt what they owe and sweep past abuses under the rug without determining the full harm borrowers have suffered," said Rep. Elijah E. Cummings, ?D.- Md., a member of the House Committee on Oversight and Government Reform and a vocal critical of the government regulators handling of the mortgage crisis.?

OCC officials said Monday the consumers will be better served under the settlement because claims will now be paid more quickly and that the cost of the review process was diverting funds that could have been used to pay claims. More than $1.5 billion has already spent on case-by-case reviews, officials said.?

?When we began the Independent Foreclosure Review, the OCC pledged to fix what was broken, identify who was harmed, and compensate them for that injury,? Comptroller of the Currency Thomas Curry said in a statement. ?While today?s announcement represents a significant change in direction, it meets those original objectives by ensuring that consumers are the ones who will benefit, and that they will benefit more quickly and in a more direct manner.??

Under the agreement, banking giants JPMorgan Chase, Bank of America, Citigroup, Wells Fargo and six other mortgage lenders will provide $5.2 billion in mortgage assistance and $3.3 billion in direct payments to wronged borrowers, according the Office of the Comptroller of the Currency and the Federal Reserve.?

?The other seven lenders include Aurora, MetLife Bank, PNC, Sovereign, SunTrust, and U.S. Bank.

The banks were among 12 lenders and two mortgage servicing companies cited by regulators in 2011 for widespread foreclosure abuses following claims that they had improperly seized homes in the wave of foreclosure filings that swamped the industry after the 2007 housing collapse.?

OCC officials said that the 10?lenders have agreed to the settlement in principal, but that the terms will not be disclosed until they are finalized. ?They said talks are continuing with other institutions ordered to review foreclosures, which include EverBank, OneWest, HSBC and Sovereign Bank.?

When industry-wide foreclosure abuses surfaced nearly two years ago, federal banks regulators required banks and servicing companies to hire consulting firms to contact borrowers and review their cases. Some 4.4 million letters were sent to potential claimants, of which about a half million applied by the Dec. 31 deadline to have their cases reviewed.?

Consumers groups working to head off foreclosures have criticized the review program from the start, in part because the consulting firms conducting the reviews were hired and paid by the financial institutions cited for wrongful practices. Since then, critics have cited slow progress in reviewing cases and compensating ?wrongful foreclosure victims.

Federal regulators said in June that the lenders conducting reviews would have to pay as much as $125,000 to borrowers whose homes were wrongly seized. But so far, no borrowers have been paid, according to regulators.?

Critics of Monday?s settlement argued that it will leave many wronged homeowners with no further recourse and that it substantially reduced the amount lenders will ultimately have to pay.?

?For many people this will be the end of the line," said Diane Thompson, an attorney with the National Consumer Law Center. ?This is a much lower number for the banks compared compare to what they were at risk for.?

(AP) ? President Barack Obama may round out his new national security leadership team next week, with a nomination for defense secretary expected and a pick to lead the Central Intelligence Agency possible.

Former Republican Sen. Chuck Hagel of Nebraska is the front-runner for the top Pentagon post. Acting CIA director Michael Morell and Obama counterterrorism adviser John Brennan are leading contenders to head the spy agency.

White House aides said the president has not made a final decision on either post and won't until he returns from Hawaii, where he is vacationing with his family. Obama is due back in Washington Sunday morning.

Obama nominated Sen. John Kerry, D-Mass., as his next secretary of state in December, his first step in filling out his second term Cabinet and national security team. Kerry, as well as the nominees for the Pentagon and CIA, must be confirmed by the Senate.

Hagel, the former senator from Nebraska, is a contrarian Republican moderate and decorated Vietnam combat veteran who is likely to support a more rapid withdrawal of U.S. troops from Afghanistan. If confirmed, Hagel would give Obama a whiff of bipartisanship in his Cabinet if confirmed.

Even before his nomination, Hagel's consideration for the top Pentagon job raised concerns among some of his former Senate colleagues, who questioned his pronouncements on Iraq, Israel and the Middle East. Troubling for some lawmakers are Hagel's comments and actions on Israel, including his reference to the "Jewish lobby" in the United States.

Hagel has also been criticized for comments he made in 1998 about an openly gay nominee for an ambassadorship. In an interview with the Omaha World-Herald in 1998, Hagel said he believed that for a U.S. ambassador, "it is an inhibiting factor to be gay" and referred to James C. Hormel as "openly, aggressively gay". He has since apologized for those comments.

If nominated and confirmed, Hagel would replace current Defense Secretary Leon Panetta.

Morell has served as the CIA's acting director since early November, after David Petraeus resigned after admitting to an affair with his biographer.

Brennan, Obama's top counterterrorism adviser, worked at the CIA for 25 years, including a stint as station chief in Saudi Arabia. He also served as chief of staff to then CIA Director George Tenet from 1999 to 2001, when he was named the agency's deputy executive director.
