Beats By Dre Pill

It seems as if everyone is making portable Bluetooth speakers these days, so it makes sense a big company like Beats by Dre doesn't want to be left out. Last year saw the Beatbox Portable, which wasn't particularly portable, and consumed batteries like an old Sega Game Gear. The Beats Pill is a smaller, rechargeable, Jawbone Jambox-like?speaker that doesn't have the huge footprint of the Beatbox line. At $199.99 (list), it's also less than half the price, though still more expensive than other Bluetooth speakers in its own class. It's well-designed and functional, but it can't handle strong bass at all, and isn't as compelling as the less-expensive?Logitech UE Mobile Boombox, our current Editors' Choice for Bluetooth speakers.

Design
Like its name implies, the Beats Pill looks like a giant pill. It's a 7.7-inch-long, 10.9-ounce cylinder with rounded ends and a band in the middle that holds all of the controls. It measures 1.8 inches across, and is cut in half on an angle with the front holding a metal grille and the back consisting of a rubberized shell, with an even more rubbery, flat "foot" running the length of the bottom side.

The middle band has a large, glowing Beats button that serves as a multifunction Play/Pause/Answer calls button, a pair of Volume Up/Down buttons, and a Power button near the back. The band also holds an NFC decal that lets you automatically pair your NFC-enabled smartphone, like my Samsung Galaxy S III, with the speaker just by tapping your phone to it. A microUSB port for charging the speaker, a 3.5mm input and output, and a Bluetooth indicator light also sit on the back panel.

The Pill comes with a few accessories besides the speaker itself. A USB-compatible AC adapter is included, along with a USB-to-micro-USB charging cable. If you don't have a Bluetooth device, the speaker comes with a 5-foot, 3.5mm audio cable to connect your devices directly.

The speaker also includes a hard shell zippered case with a loop on it. The case fits the speaker perfectly, but isn't particularly useful. It doesn't present the Pill in a more convenient-to-carry package besides the loop of fabric, and when zipped up?the only way to keep the speaker secure?the case muffles all sound. Since the speaker is already fairly rugged in its design and can be used outside as long as you don't get it too wet or dirty, the case doesn't serve any really useful function.

Beats Pill

Performance
You can't expect too much bass from a speaker so small, but the Beats Pill is particularly weak on that front. The speaker employs a processing algorithm that softens parts of tracks so they don't blow out the speaker, but the processing can take a second to kick in, so it might as well be useless. The dark, atmospheric sounds of Bathory's "Odens Ride Over Nordland" filled our test room comfortably, with the beat of hooves occasionally popping before the speaker could adjust but otherwise sounding natural. Our bass test track, The Knife's "Silent Shout," produced notable popping throughout the track, distorting heavily on the drumbeats.

The distortion occurs primarily when volume is maximized on both the audio device and the speaker. At slightly lower volume levels, songs like Green Day's "Kill the DJ" and Maximum the Hormone's "Louisiana Bob" sound clear and full, lacking notable bass but not distorting. However, it feels like you're missing out on how loud the speaker could be, if it had better audio processing to reduce distortion at high volume levels.

The Beats Pill doubles as a speakerphone, and serves well in that function. While not exceptionally clear, I could hear the caller well, and the caller could make out everything I said. The Pill puts enough power behind the speaker and sensitivity behind the microphone that it significantly improved the speakerphone feature of my Samsung Galaxy S III.

The Beats Pill offers a unique form factor and doubles as a good speakerphone, but it simply doesn't offer good enough sound quality to justify its $200 price tag. While you might get a reasonably loud and clear listening experience on one track, the next might pop distractingly and force you to tweak the volume just because it has slightly more bass. If the speaker handled bass distortion slightly better, it would have been a much stronger contender. As it is, you're better off getting the Jabra Solemate for its superior audio quality, or the Editors' Choice?Logitech UE Mobile Boombox?for its small size and exceptional value. Both speakers handle the low-end better, even if neither offers particularly strong bass, and the Mobile Boombox is just as functional as a speakerphone at half the price of the Pill.

Does the Horror of Pet PCS Keep You Down? | SpouseBUZZ.com

Our dog Gunner and his girlfriend Abby recently had puppies. In lieu of a stud fee, Abby?s owner offered us pick of the litter. When the pups were ready to venture out on their own, my family played with each one and brought home the cutest little black Labrador retriever in the entire world. We were all madly in love.

Unfortunately, we knew we wouldn?t be keeping sweet Princess Buttercup Penny Lane (can you tell I have a 5-year-old daughter?). When we first found out that Gunner was going to be a father, we loved the idea of adopting one of his offspring so he could have a playmate. But I quickly reconsidered adding another dog to our family after flashing back to visions of the last time we PCS?ed with a dog.

Ok, so maybe shipping a dog who had never been on an airplane before all the way to Japan was destined to be a awful experience, and maybe I shouldn?t let that one horrible move keep me from sharing my love with another pet. Unfortunately, anytime someone asks me about PCS?ing with a dog, all I can think about is shoving my poor 85-pound dog into a crate lined with towels, the crate we duct-taped with zipper bags filled with dog food and a note requesting that any possible handlers talk to our poor, anxiety-ridden dog.

I remember the trouble we had learning the requirements for moving a dog overseas, the debate with the vet over whether or not to drug him during the flight, the down-to-the wire last minute fear that we would have to cancel our flight because it was summertime and the temperatures were dangerously close to the maximum heat levels allowed in cargo hold where the dog would be traveling. And then there was the guilt of finally getting him through customs only to shove him back in that hateful crate for the last leg of the trip. By the time we retrieved our retriever at our final destination, I think I was just as traumatized as he was.

Even Princess Buttercup Penny Lane?s adorable puppy dog eyes couldn?t keep me from flashing forward to future PCS?es. I knew it wasn?t the right time in our military life to add a second extra large dog crate to our inventory list. I hated handing Gunner?s daughter over to a friend (yes, I promise she went to a good home), but one military brat of the pet variety is enough for me. Any more than that just adds complications to an already complicated lifestyle.

However, unlike me, it seems many military families aren?t fazed by a houseful of pets. We asked our Facebook followers how many MilPets they have, and?most of the commenters had multiple pets of multiple species. Dogs, cats, fish, bunnies, guinea pigs, chickens, birds, lizards, a bearded dragon and even horses! And it sounds like these pets have traveled all over the world. Military life doesn?t slow these animals down one bit.

So MilPet owners, how many pets do you have? Does having pets make PCS?ing more difficult? Have you ever had to leave pets behind because of a PCS move?

While you?re in the commenting mood, take our poll to the right of the screen and then check out the results below. We know that if there?s nothing else pet owners feel strongly about ? it?s their love for their animals. We want to hear from you!

(By the way, this is a great reference for those of you PCS?ing overseas with pets. I really could have used this 8 years ago!)

PCB weighs golf cart parking

Published: Monday, January 14, 2013 at 21:01 PM.

?

PANAMA CITYBEACH ? The Panama City Beach Planning Board knocked down a proposal Monday to give beach businesses incentives for offering specified parking for golf carts.

While the city offers businesses an option to reduce the number of vehicular parking spaces required if they provide additional bicycle parking, the planning board ultimately decided there was not a need for specified golf cart parking.

The request to explore the idea came from the Panama City Beach City Council after the council approved expanding incentives for bicycle parking citywide. They previously were offered only for the Front Beach Road area.

The city allows businesses to reduce the required vehicular parking by no more than 5 percent if enough bike parking is provided. Mel Leonard, director of the city?s building department, presented to the Planning Board a proposal to consider allowing businesses to reduce vehicular parking by up to 7 percent by providing a combination of bike and golf cart parking.

Because providing bicycle parking is required, Leonard said making golf cart parking mandatory was also an option for the board to consider, but it would be complicated because not all businesses can be accessed by golf cart.

Golf carts are permitted to operate on city streets within Panama CityBeach limits as long as the operator has a valid driver?s license and adheres to safety regulations. To operate on city streets, golf carts do not need to be licensed.

Unregistered golf carts are not permitted on state roads, including Front, Middle or Back Beach Roads, Thomas Drive and South Thomas Drive, North Lagoon Drive, State 79, Churchwell Drive, Richard Jackson Boulevard, Alf Coleman Road, Clara Avenue, Hill Road, Beach Boulevard and Powell Adams Road.

Despite the restrictions, Leonard said many Panama CityBeach businesses are still accessible by golf cart.

?I like the idea of it, but I think it?s a bit premature,? said board member Craig Duran, who suggested the board might look into special parking spots for motorcycles, mopeds and electric cars.?

Board member Clair Pease said that with a parking problem in Panama CityBeach already, she didn?t think businesses should be allowed to further reduce their parking spaces.

The board voted unanimously to leave the parking code as is and revisit it a future date if golf cart parking becomes an issue in the area.?

Liver controls wasting in cancer

Jan. 14, 2013 ? Many cancer patients suffer from a dramatic loss of fat and muscle tissue. This extreme wasting, or cachexia, is often the actual cause of death in cancer patients. Heidelberg scientists have now discovered in mice that tumors stimulate the production of a key gene switch in the liver. Activity of this switch lowers blood fat levels so that the animals lose weight. The researchers have been the first to demonstrate that the liver controls cancer-induced cachexia. This finding may lead to approaches to slow down this fatal loss of body mass.

Cachexia or wasting affects up to 70 percent of all cancer patients depending on the type of cancer. It is characterized by a dramatic loss of body weight independent of food intake. Cachexia is seen particularly often and most pronounced in patients suffering from cancers of the digestive tract and the lungs. They may lose up to 80 percent of body fat and skeletal muscle. Muscle loss leads to weakness and immobility of patients and poorer response to treatment. An estimated 20 percent of cancer deaths are considered to be a direct consequence of cachexia, with failure of the respiratory muscles as a frequent cause of death.

"Doctors used to believe that cancer re-programs metabolism focusing all energy into tumor growth," says Prof. Dr. Stephan Herzig, who heads a joint research department of the German Cancer Research Center (DKFZ), Heidelberg University and Heidelberg University Hospital. However, by now researchers presume that cachexia is the body's response to various harmful stimuli originating directly from the growing tumor. To explore the causes of cachexia, Stephan Herzig, an expert in metabolism, took a closer look at the liver as the key controlling point of metabolism. "Cachexia patients frequently show an inflamed fatty liver -- this was a major clue for this organ being involved."

The researchers found extremely low lipid (blood fat) levels in cancerous mice, therefore they lack the most important energy source. However, they accumulate fat in the liver. The low lipid levels in the diseased animals are due to their liver releasing only very little VLDL (very low density lipoprotein). VLDL facilitates the transport of fat in the bloodstream. Moreover, the genes for all major steps of lipogenesis are blocked in the livers of cancerous mice.

"This is a clear indication of a central gene switch in the liver driving cachexia," says Stephan Herzig. He therefore searched for differences in protein switches regulating gene activity and hence hepatic energy metabolism in cancerous and healthy mice. Herzig's team found significant differences in a poorly studied gene switch called TSC22D4, which is found in larger amounts in cancerous mice than in healthy control mice.

Herzig's team was able to clearly demonstrate the key role of TSC22D4 in the onset of cachexia. When the researchers silenced the switch specifically in the animals' livers the organ subsequently went back to producing enough VLDL to make lipid levels in the cancerous animals rise. In addition, the genes involved in lipogenesis got boosted again.

"Our results prove, for the first time, that dramatic loss of body mass may be controlled by the liver," says Stephan Herzig. "We also learned recently that TSC22D4 shows exactly the same effect in human hepatic cells. There is evidence that certain metabolites control this gene switch and might offer the possibility to slow down the fatal wasting process. However, we don?t have proven this approach by now. This is what we will do next."

Identity crisis in the GOP

By David M. Shribman?/?Pittsburgh Post-Gazette

Let's start with two unavoidable truths: The country's fiscal crisis has not been addressed. The battle to redefine the Republican Party will occur long before any presidential candidates land in Iowa and New Hampshire.

Congress addressed barely a fraction of the economic conditions it was hired to fix. The battle over spending has yet to begin -- and the one about entitlements hasn't even been engaged.

The struggle over the future of the Republican Party? It won't wait until campaigning for the caucuses on the prairies and the primary in the mountains three years from now.

Republicans may be talking wistfully about Jeb Bush and Bobby Jindal, but the fact that I have to tell you Mr. Jindal is the governor of Louisiana tells you how premature -- how beside the point -- the presidential speculation is.

The GOP problem has many dimensions. One is that a dozen Republicans voted against the re-election of their own speaker. One is that that speaker was rendered irrelevant by his own caucus during the December drama over the fiscal cliff. Another is that the Republican caucus in the 113th Congress may be even more militant than the one in the last Congress.

But there is more. The division between the Republicans' isolationists and neoconservatives has never been addressed, let alone healed, and the nomination of former GOP Sen. Chuck Hagel to be defense secretary will likely exacerbate those tensions. The other division in the party -- the one between regulars and Tea Partiers -- is far deeper and far more significant than the GOP split of the last generation, between religious conservatives and economic conservatives.

That division may have grown in the past week, with the swearing-in of new lawmakers who received big contributions in their tea cups for the fall election. These legislators would have voted against the fiscal cliff legislation -- and would have added to the chorus of those criticizing House Speaker John Boehner of Ohio, increasingly the symbol of fecklessness and compromise, two words melded in meaning in the capital in recent years.

These lawmakers will oppose any compromises with the president and will do so with political impunity. Some of them won Republican primaries against establishment figures who might have been lured into a grand bargain, or even an itty-bitty bargain. Their financial supporters and their districts will back them -- will cheer them on -- if they foment rebellion.

Capitol Hill hasn't see a generation of newcomers like the ones from the last two elections since the Watergate class of 1974, and those Democrats changed Congress indelibly. If you doubt it, consider whether the phrase "campaign finance reform" would have any meaning whatsoever if those Watergate babies hadn't been elected. Five of these political mastodons remain in Washington 38 years later. Their average American Conservative Union rating for 2011, the latest year for which figures are available, was under 6 on a scale of 100. Two of the three members of the Utah House delegation won ratings over 95.

All of this ferment on the right would be startling to a visitor from another age, accustomed to viewing Republicans as bland oatmeal, preoccupied by debts and deficits (but in many cases being dependable -- in fact, indispensable -- advocates for measures to extend rights to Americans left out or falling behind).

And yet the beginning of all wisdom in today's Republican Party is that the party's record against President Barack Obama is 1-4.

The GOP's lone victory came in the 2010 midterm congressional elections, which is not insignificant; it changed the chemistry of Congress. But its defeats are perhaps more important: the president's two election triumphs, the passage of Obamacare and last month's fiscal cliff. Mr. Obama, the only Democratic president in three-quarters of a century to win a majority victory twice in a row, may not have a ferocious fastball, but he has mastered the slider and the curve.

He has also struck out the speaker repeatedly. It is Mr. Boehner's sad lot to fight a two-front war, one with the president, the other with the firebrands in his caucus. He says he won't negotiate with the president anymore. He can't avoid negotiating with his own members.

The rebellion he faces has few precedents, the most recent being the emergence in the 1980s of the Boll Weavil Democrats, who favored tax and spending cuts. Democrats then could defect to the other party -- Phil Gramm of Texas was the most prominent -- but that option is not available to today's rebels. They're stuck in the GOP, and the GOP is stuck with them.

The Republicans -- all of them, not just the rebels -- now are saying that the passage of the New Year's Day fiscal-cliff legislation marks the end of the tax debate and the beginning of the spending debate. They may be right. But not necessarily.

If they define tax increases as any increase in revenues through direct assessments on taxpayers -- and many do -- they may be wrong. Some proposals to shore up Social Security involve increased revenues, perhaps by lifting or eliminating the income ceiling on individual contributions, now set at $113,700. (By the way, wasn't the quiet elevation of that ceiling by $3,600 at the start of the year a tax increase?) And that's only one example.

The Republicans have put away the tax tool. Mr. Obama may not have.

An equally vital question is the face Republicans present to a public that is undergoing dramatic demographic changes and that signalled only two months ago that it is moving away from the Republicans. Stated simply: The Republic is growing less white while the Republicans are growing more so.

The two unavoidables are haunting the GOP: death (of the old political demographics) and taxes (of any sort).

The other day BuzzFeed, a source not ordinarily cited on op-ed pages, declared the presidential election in the Czech Republic "the most interesting election in the world." They might be right. Don't miss the candidate with the facial tatoos.

But there is almost no contest for the crown for the most interesting political party in the world. It's the party that for decades was the dullest party in the world. Praise the Lord and pass the teacup.

Pakistan asks Western diplomats, UN group to ease India border tension

ISLAMABAD, Jan. 11 ?Pakistan Friday conveyed its concern to the Western diplomats and the UN Military Observers Group for India and Pakistan over ?repeated border violation by Indian army?, urging them to play their role in defusing the tension, the country?s top diplomat said.

Pakistan said that Indian troops have killed two of its soldiers in five days along the of Line of Control (LoC), which divides the two countries in the disputed Kashmir region.

On its part, India also said Pakistani troops killed two of its troops and that Pakistani forces had crossed into its part of Kashmir on Tuesday.

Pakistani Foreign Secretary Jalil Abbas Jilani at a news briefing after discussions with European diplomats in Islamabad said that members of the diplomatic community have expressed concern over rising tension and wanted peaceful relations between Pakistan and India.

He expressed the hope that they would play positive role in de- escalating the current state of violations on the LoC.

The Foreign Secretary said Pakistani defence authorities have already briefed the UN Military Observers Group about these violations. He said Pakistan has already offered UN probe as the Group is the only neutral mechanism available to both countries to come out with truth.

Replying to a question whether Pakistan would take up the issue at the UN Security Council, the Foreign Secretary said all options are open.

The Foreign Secretary said repeated violations of LoC by Indian troops and killing of Pakistani troops is very unfortunate particularly because the two countries invested very heavily in recent months in building up peace and stability not only between them but in the region.

He said Pakistan wants to have friendly and cooperative relations with all neighbours including India. ?We expect the Indian Government to ensure that the sanctity of the LoC is maintained at all costs.?

Tips On Using Self Improvement To Your Advantage | Rodt St

Wednesday, January 9th, 2013. Author : Max Cohen. 7 views.

Thousands of Americans of all ages would like to become better at something or improve upon one of their personal qualities. For some, this manifests itself in personal ways, whereas others want to focus on their professional careers. Read this article for some tips on how to use personal development to your benefit.

The first step towards self improvement is learning how to be a leader. Leadership has many definitions, but many people think of it as ?influence.? Think about your own leadership experiences. Which events had the most impact on the way you live your life? What changes did those events bring forth in you? What are your qualities that make you shine in a team environment? When you can answer those questions, you?ll know how to be part of a team.

When you are angered by something, take the time to take a breath and count up to ten before you react. Take a cleansing breath and focus on something positive. These tips will help you remain calm and keep from saying something you will regret later.

A great suggestion to enhance your personal development is to make certain that value is placed on those things you think of as being the best. Setting high standards for yourself can help you achieve personal development you desire.

TIP! True leaders are humble as they exercise their power. Be rebuking yet gentle, and always remember in order to lead, you must know how to serve.

Make concrete plans for your life and take actions to accomplish those goals. You will never create the life you desire by simply fantasizing about it. Take action, and turn your dreams into reality.

One interesting trait the might be worth developing is called ?sexual capital.? It does not translate to using sex to get everything you want. It is as simple as using charm. Since some people do not have good skills socially, it will help them get farther in certain life aspects.

No matter what, you must adhere to one rule. You have to take an active role in you life, and not just passively accept the things in your life that you want to change. Being a passive observer to the world around you removes you from the game entirely. Do not let that happen.

Having a better life often happens because of willpower, and keep in mind that the things you wish for others might have an effect on you. Thus, never wish down on someone and always pray for the best. Focusing on positive things will help you stay happy and motivated.

TIP! See what is in the way between your success and you. This is hard to do for a lot of people.

Choose one aspect of yourself that needs improvement, and concentrate on that. It may be that you have several such things which you could concentrate on, but by selecting just one, you stand a better chance of prevailing. Remember that the goal is to change for good, and that those changes have to come slowly from the inside out.

Begin a fund for emergency purposes. Most of the time, it seems that the smallest unexpected expense adds more credit card debt. However, you can protect yourself from this happening by depositing a few dollars into a savings account each week. You will be surprised at how quickly your emergency fund will increase. You can get your debt moving in the right direction (that is, downward) by making use of that fund instead of credit.

Try perusing some books on personal development. These types of reading materials can often provide new insights and give you methods to alter your behavior in lifelong positive ways. It is important, however, that you choose a book that has received good reviews. There is no policing on the writers of self improvement books, and some of them are sorely lacking in credibility.

Stress is the foe of happiness. Stress in the mind hurts us both mentally and physically across our body. If we want to think clearly and strive for our goals with neat, calm purpose, we must eliminate the stress in our minds. Schedule in relaxation times throughout the day, clearing your mind in a peaceful setting. This peaceful mental relaxation will refresh your mind, and improve your inner self.

TIP! It?s important to remember that faith and love go hand in hand. This will help you focus on the things that are truly important.

Figure out what is really important to you and focus on those things in your life. Focus on the more positive things in life because they matter. Do not focus on the negative things because they don?t matter, and you will have a lot better inner peace.

Many people have a feeling that something is amiss in their lives, but they are not sure exactly what the problem is or where to begin to correct it. This article contains some great tips to get you started, but remember, the hard work remains on you. Go back over these tips and remember the basics when you find yourself lacking motivation.

Small Screen, Bigger Picture | Copyright Alliance

The following is a piece written by?Eleanor M. Lackman?of Copyright Alliance Legal Advisory Board member Cowan DeBaets Abrahams & Sheppard LLP.? For more from CDAS, be sure to visit their Entertainment & Media Law Blog.???

On December 27, 2012, the U.S. District Court for the Central District of California issued a preliminary injunction against Aereokiller (formerly known as BarryDriller.com), a service founded by Alki David, someone not unfamiliar with television transmission and the law.? Previously, in conjunction with rulings involving a similar technology at issue in?WPIX v. ivi?in New York, David?s prior television-over-the-Internet service known as FilmOn had been enjoined for making unauthorized public performances in violation of television networks? copyright rights under Section 106(4) of the Copyright Act.? This time around, David?s Aereokiller service was set up to create unique copies of broadcast television streams, one per user, so that the transmission of those streams would be a private ? not public ? performance to that particular user.?

Important to the facts of the case is the outcome in?ABC v. AEREO, involving a service on which David claimed Aereokiller was modeled.? In mid-2012, Aereo had prevailed in the Southern District of New York against a motion for a preliminary injunction against its broadcast-to-Internet service, on the ground that a 2008 Second Circuit decision known as?Cartoon Network v. Cablevision?insulated a retransmitter of copyrighted content from liability if the transmissions were made from individualized copies requested by the user.? In Cablevision?s case, the transmissions came from hard drives stored at Cablevision?s facility that were set up in such a way as to allow the service to appear to the consumer to function just like an in-home DVR.? With the ?RS-DVR? system in?Cablevision, subscribers would choose a show, hit ?record,? and play the show back from the copy saved in Cablevision?s facilities.? In Aereo?s case, the technology captured television broadcast signals on a series of dime-sized antennas, with one antenna assigned to each subscriber, located on a rooftop in Brooklyn.? From there, the broadcasts would be streamed to subscribers on an individualized basis.? The?Aereo?court found the architecture legally indistinguishable from that in?Cablevision. ?At the end of November, the parties argued the copyright owners? expedited appeal of the district court?s?Aereo?ruling.? A decision remains pending.

Just like the defendant in the?Aereo?case claimed that its system was designed in part to follow?Cablevision??to a T,? the defendant in theAereokiller?case claimed heavy reliance on?Aereo, stating that it was ?technologically analogous? to the system that the New York court found to be non-infringing.? Much of the briefing focused on whether this was actually the case; the plaintiffs argued in the alternative that the technology likely was essentially the same as the FilmOn technology.

Despite the parties? focus on the system?s architecture, Judge Wu avoided the issue entirely.? Rather than distinguishing the cases on their facts, the court rejected the reasoning in?Cablevision?and?Aereo, indicating that the current Copyright Act was subject to a different interpretation than the Second Circuit courts had reached.? In the Second Circuit, the judge explained, cases ?have held that where a transmission of a work over the internet is made from a copy of a work made at the direction of and solely for use by a single user, there is no public transmission.? ?But, the court noted, ?that Second Circuit law has not been adopted in the Ninth Circuit, and this Court would find that the Ninth Circuit?s precedents do not support adopting the Second Circuit?s position on the issue.?? As if to underscore the division between the Second and the Ninth Circuits on the question, Judge Wu expressly relied upon a Northern District of California case,?On Command v. Columbia Pictures, a case that the district judge in?Cablevisiondiscussed extensively, and which the Second Circuit criticized in reversing the lower court?s ruling.

In concluding its analysis on plaintiffs? likelihood of success on the merits, the court did find some analogous copyright precedent, but it was not the precedent from?Cablevision.? Instead, Judge Wu found Aereokiller?s arguments reminiscent of the arguments cable retransmitters made four decades ago in the?Fortnightly?andTeleprompter?cases ? rulings that Congress overturned by enacting the 1976 Copyright Act with the inclusion of broad definitions of what it means to ?transmit? a work and to perform a work ?publicly,? including by transmission.? The court further explained that the revisions to the copyright laws confirmed that whatever an individual might lawfully do for herself, the legality as to the individual has no bearing on the legality of what a commercial provider could do for a group of people.? Finding that in this case, as with cable operators, copyright royalties must be paid for retransmission of copyrighted material, the court refused to find?Cablevision?and?Aereo?to be binding.

Despite the pointed holding, the court?s ruling is limited geographically so as to not interfere with?Cablevision?or?Aereo?s reach.? Conscious of the differing interpretations between Judge Wu and his east-coast counterparts of the statutory language, the court found that the Aereokiller service could be limited to avoid reach into the Ninth Circuit and, as a matter of comity, issued its order accordingly.? Thus, depending on what happens on appeal both in this case and in?Aereo, we could see the geographic scope of the injunction flip or disappear entirely.? And if the?Aereokiller?and?Aereo?decisions are either both affirmed or both reversed, it may be the Supreme Court?s task to resolve the circuit split and again take up the question of copyright in the age of evolving television distribution.? Stay tuned.

Sony Xperia Z: hands-on with the new flagship at CES 2013 (video)

Sony Xperia Z handson with the new flagship at CES 2013 video

Sony has had over a year now to dust away any residual Ericsson branding and with a reinvigorated direction towards mobile, it's welcoming the CES crowds of Las Vegas with two new smartphones -- the Xperia Z and the Xperia ZL. Both are running Android Jelly Bean, have 5-inch 1080p screens laced with Sony's new Bravia Mobile 2 technology, quad-core 1.5GHz Snapdragon S4 Pro and new 13-megapixel Exmor RS camera sensors, capable of recording HDR video.

Has Sony finally crafted a flagship able to go toe-to-toe with the competition? Well, the Xperia Z exudes class -- and it's light. With about the same thickness as the iPhone, the phone is similar with all straight surfaces, barring some slightly rounded corners. Sony's calling the design language "omnibalance" and you can expect to see similar design licks in its other products in the near future. Picking it up, it feels better and more premium than any phone we've seen from Sony before and, oddly, it's even waterproof. Comparing the Xperia Z against the Xperia ZL, the oblong, broad Xperia Z felt almost too big in our hands; the ZL felt much more at home. Sony's barely unveiled them on stage at its press event, but we got the chance to play with both devices earlier today, (just about) wrapping our fingers around both the Xperia Z and the slightly smaller Xperia ZL. So what did we think? Hop on after the break for our hands-on video and full impressions.

Banks reach $8.5B settlement on mortgage abuse

15 hrs.

Ten of the biggest U.S. mortgage companies have agreed to an $8.5 billion settlement with federal regulators that will end a case-by-case review program to identify victims of widespread foreclosure abuses.

With the latest multi-billion-dollar settlement, the nation?s giant mortgage lenders are hoping to put the mortgage mess ?behind them. But critics of the deal fear it may also leave behind millions of foreclosed homeowners who got little or no relief from the lenders that created the mortgage mess in the first place. ?

"I have serious concerns that this settlement may allow banks to skirt what they owe and sweep past abuses under the rug without determining the full harm borrowers have suffered," said Rep. Elijah E. Cummings, ?D.- Md., a member of the House Committee on Oversight and Government Reform and a vocal critical of the government regulators handling of the mortgage crisis.?

OCC officials said Monday the consumers will be better served under the settlement because claims will now be paid more quickly and that the cost of the review process was diverting funds that could have been used to pay claims. More than $1.5 billion has already spent on case-by-case reviews, officials said.?

?When we began the Independent Foreclosure Review, the OCC pledged to fix what was broken, identify who was harmed, and compensate them for that injury,? Comptroller of the Currency Thomas Curry said in a statement. ?While today?s announcement represents a significant change in direction, it meets those original objectives by ensuring that consumers are the ones who will benefit, and that they will benefit more quickly and in a more direct manner.??

Under the agreement, banking giants JPMorgan Chase, Bank of America, Citigroup, Wells Fargo and six other mortgage lenders will provide $5.2 billion in mortgage assistance and $3.3 billion in direct payments to wronged borrowers, according the Office of the Comptroller of the Currency and the Federal Reserve.?

?The other seven lenders include Aurora, MetLife Bank, PNC, Sovereign, SunTrust, and U.S. Bank.

The banks were among 12 lenders and two mortgage servicing companies cited by regulators in 2011 for widespread foreclosure abuses following claims that they had improperly seized homes in the wave of foreclosure filings that swamped the industry after the 2007 housing collapse.?

OCC officials said that the 10?lenders have agreed to the settlement in principal, but that the terms will not be disclosed until they are finalized. ?They said talks are continuing with other institutions ordered to review foreclosures, which include EverBank, OneWest, HSBC and Sovereign Bank.?

When industry-wide foreclosure abuses surfaced nearly two years ago, federal banks regulators required banks and servicing companies to hire consulting firms to contact borrowers and review their cases. Some 4.4 million letters were sent to potential claimants, of which about a half million applied by the Dec. 31 deadline to have their cases reviewed.?

Consumers groups working to head off foreclosures have criticized the review program from the start, in part because the consulting firms conducting the reviews were hired and paid by the financial institutions cited for wrongful practices. Since then, critics have cited slow progress in reviewing cases and compensating ?wrongful foreclosure victims.

Federal regulators said in June that the lenders conducting reviews would have to pay as much as $125,000 to borrowers whose homes were wrongly seized. But so far, no borrowers have been paid, according to regulators.?

Critics of Monday?s settlement argued that it will leave many wronged homeowners with no further recourse and that it substantially reduced the amount lenders will ultimately have to pay.?

?For many people this will be the end of the line," said Diane Thompson, an attorney with the National Consumer Law Center. ?This is a much lower number for the banks compared compare to what they were at risk for.?

(AP) ? President Barack Obama may round out his new national security leadership team next week, with a nomination for defense secretary expected and a pick to lead the Central Intelligence Agency possible.

Former Republican Sen. Chuck Hagel of Nebraska is the front-runner for the top Pentagon post. Acting CIA director Michael Morell and Obama counterterrorism adviser John Brennan are leading contenders to head the spy agency.

White House aides said the president has not made a final decision on either post and won't until he returns from Hawaii, where he is vacationing with his family. Obama is due back in Washington Sunday morning.

Obama nominated Sen. John Kerry, D-Mass., as his next secretary of state in December, his first step in filling out his second term Cabinet and national security team. Kerry, as well as the nominees for the Pentagon and CIA, must be confirmed by the Senate.

Hagel, the former senator from Nebraska, is a contrarian Republican moderate and decorated Vietnam combat veteran who is likely to support a more rapid withdrawal of U.S. troops from Afghanistan. If confirmed, Hagel would give Obama a whiff of bipartisanship in his Cabinet if confirmed.

Even before his nomination, Hagel's consideration for the top Pentagon job raised concerns among some of his former Senate colleagues, who questioned his pronouncements on Iraq, Israel and the Middle East. Troubling for some lawmakers are Hagel's comments and actions on Israel, including his reference to the "Jewish lobby" in the United States.

Hagel has also been criticized for comments he made in 1998 about an openly gay nominee for an ambassadorship. In an interview with the Omaha World-Herald in 1998, Hagel said he believed that for a U.S. ambassador, "it is an inhibiting factor to be gay" and referred to James C. Hormel as "openly, aggressively gay". He has since apologized for those comments.

If nominated and confirmed, Hagel would replace current Defense Secretary Leon Panetta.

Morell has served as the CIA's acting director since early November, after David Petraeus resigned after admitting to an affair with his biographer.

Brennan, Obama's top counterterrorism adviser, worked at the CIA for 25 years, including a stint as station chief in Saudi Arabia. He also served as chief of staff to then CIA Director George Tenet from 1999 to 2001, when he was named the agency's deputy executive director.
